&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.En data 17 de novembre de 2011 es va publicar al Butlletí Oficial de les Illes Balears número 112 la Resolució del conseller d’Administracions Públiques per la qual es convocaven les proves selectives per cobrir sis places vacants de l’escala de funcionaris amb habilitació de caràcter estatal, subescala de secretaria, categoria d’entrada, corresponents a l’oferta d’ocupació pública de l’any 2008 de la Comunitat Autònoma de les Illes Balears (tres places per cobrir pel sistema general d’accés lliure i tres pel sistema de promoció interna).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.Mitjançant resolució de 20 de juliol de 2012, el conseller d’Administracions Públiques va nomenar funcionaris en pràctiques els aspirants que varen superar les proves selectives i els va admetre al curs selectiu per a l’accés a l’escala de funcionaris amb habilitació de caràcter estatal, subescala de secretaria, categoria d’entrada.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.Una vegada finalitzat el procés de selecció s’ha de realitzar, d’acord amb la base 12 de la Resolució de convocatòria, el nomenament dels aspirants que han superat les proves d’accés i el curs selectiu abans esmentat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4.La directora general de Funció Pública, Administracions Públiques i Qualitat dels Serveis ha emès la proposta de resolució de 22 d’octubre de&amp;nbsp; 2012 en els termes que s’aproven en aquesta resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.El punt 4 de la Disposició Addicional segona de la Llei 7/2007, de 12 d’abril, de l’Estatut Bàsic del Empleat Públic, que disposa que és competència de les comunitats autònomes la selecció i el nomenament dels funcionaris amb habilitació de caràcter estatal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.El Decret 12/2011, de 18 de juny, del president de les Illes Balears, pel qual s’estableixen les competències i la estructura orgànica bàsica de les conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 23/2011, de 5 d’agost, atribueix al conseller d’Administracions Públiques les competències en matèria de funcionaris amb habilitació de caràcter estatal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.Nomenar funcionaris amb habilitació de caràcter estatal, de la subescala de secretaria, categoria d’entrada, als aspirants que han superat les proves d’accés i el curs selectiu convocats per Resolució del conseller d’Administracions Públiques de 20 de juliol de 2012, que es relacionen a l’annex 1.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.Trametre la relació de funcionaris nomenats al Ministeri d’Hisenda i Administracions Públiques perquè procedeixi a acreditar l’habilitació estatal obtinguda i la seva inscripció en el corresponent registre, d’acord amb el que disposa el punt 4 de la Disposició Addicional segona de la Llei 7/2007, de 12 d’abril, de l’Estatut Bàsic del Empleat Públic.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant el conseller d’Administracions Públiques, en el termini d’un mes comptador des de l’endemà d’haver-ne rebut la notificació, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver rebut la notificació de la Resolució, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
