    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No havent-se presentat pels interessats, durant el termini d’exposició al públic, cap reclamació contra l’Ordenança reguladora del preu públic per la prestació del servei de l’Escola Municipal d’Adults i de l’Escola Viva, aprovada inicialment per l’Ajuntament Ple, en sessió de dia 20 d’agsot de 2012, ha resultat definitivament aprovat, i per aquest motiu, es publica el text íntegre del mencionat acord, que és el següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;“&lt;/strong&gt;PRIMER.- Aprovar inicialment la modificació de l’ordenança reguladora del preu públic per la prestació del servei de l’Escola d’Adults i de l’Escola Viva (BOIB Num. 186 de 13-12-2011), en el sentit següent: &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“Article Únic. Modificació de l’Ordenança reguladora del preu públic per la prestació del servei de l’Escola Municipal d’Adults i de l’Escola Viva (BOIB Núm 186 de 13-12-2011).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Un. Es modifica l’article 4, que quedarà redactat de la següent forma: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“Article 4. Quantia. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. La quantia a abonar per la prestació del servei de l’Escola Municipal d’Adults serà la següent: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Dos. Es modifica l’article 5, que quedarà redactat de la següent forma: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“Article 5. Bonificacions.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. Al servei de l’Escola Municipal d’Adults s’hi aplicaran les següents bonificacions: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;a. &lt;/em&gt;&lt;em&gt;Tindran una bonificació d’un 10% de la quota total els alumnes menors d’edat, els alumnes de famílies nombroses i els residents al nucli de Son Serra de Marina prèvia presentació de la documentació que acrediti aquestes circumstàcies. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;b. &lt;/em&gt;&lt;em&gt;Gaudiran d’una bonificació d’un 25% de la quota total els alumnes matriculats a l’Escola Municipal d’Adults afectats per una minusvalidesa de grau igual o superior a un 33%.&amp;nbsp; &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;c. Les bonificacions anteriorment citades no es podran acumular i en el supòsit de que fos possible l’aplicació de més d’una, l’obligat haurà d’optar per una d’elles. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;2. Als usuaris del servei de l’Escola Viva se’ls podrà aplicar les següents bonificacions: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;a. &lt;/em&gt;&lt;em&gt;Una bonificació del 100% si els ingressos de tots els membres de la unitat familiar son inferiors al 50% del SMI.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;b. &lt;/em&gt;&lt;em&gt;Una bonificació del 90% si els ingressos de tots els membres de la unitat familiar representen entre el 51% i el 60% del SMI. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;c. &lt;/em&gt;&lt;em&gt;Una bonificació del 50% si els ingressos de tots els membres de la unitat familiar representen entre el 61% i el 70% del SMI.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;d. &lt;/em&gt;&lt;em&gt;Una bonificació del 20% si els ingressos de tots els membres de la unitat familiar representen entre el 71% i el 80% del SMI.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;e. &lt;/em&gt;&lt;em&gt;Una bonificació del 10% si els ingressos de tots els membres de la unitat familiar representen entre el 81% i el 90% del SMI.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;f. &lt;/em&gt;&lt;em&gt;Una bonificació del 5% si els ingressos de tots els membres de la unitat familiar son iguals al SMI.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Als efectes d’aplicar aquestes bonificacions, es computaran els ingressos de tots els membres de la unitat familiar amb independència del seu tipus i concepte.&amp;nbsp; &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;3. Correspondrà al Batle la concessió de les bonificacions, prèvia sol·licitud de l’interessat i, en el cas de l’Escola Viva, la concessió es farà, d’ofici, prèvia proposta formulada pel Cap de Serveis Socials, que serà qui proposarà a les persones a les que se li ha de concedir la bonificació. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;4. Seran atorgades per curs escolar. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;5. No es concedirà cap més exempció ni bonificació, llevat de les especificades en el present precepte.” &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Tres. Es modifica l’article 6, que quedarà redactat de la següent forma: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“Article 6. Normes de gestió. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. El pagament de les tarifes es farà anticipadament en el moment de sol·licitar la prestació del servei tant de l’Escola d’Adults com de l’Escola Viva i seran irreductibles. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;No obstant l’anterior, i pel que fa a les tarifes fixades per l’ensenyança reglada, e&lt;/em&gt;&lt;em&gt;s podrà sol·licitar el fraccionament del deute tributari. No s’exigirà garantia ni interès de demora si el venciment de l’últim pagament es produeixi dins l’any corrent. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;La tarifa prevista per l’Escola Viva, en el supòsit de que el servei es presti per termini superior a un mes, s’abonarà de forma bimensual. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;2. Els pagaments es faran mitjançant la domiciliació bancària a entitats designades per l’Ajuntament com a col·laboradores.&amp;nbsp; A aquets efecte, les persones obligades al pagament emplenaran full de domiciliació segons el model aprovat per l’Ajuntament. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;3. Els deutes per el preu públic regulat en la present Ordenança es podran exigir pel procediment administratiu de constrenyiment.” &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;DISPOSICIÓ FINAL ÚNICA&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;La present Ordenança, aprovada pel Ple d’aquest Ajuntament en sessió celebrada el ____ de _____________ de 20__, entrarà en vigor en el moment de la seva publicació íntegra en el Butlletí Oficial de les Illes Balears i serà d’aplicació a partir del dia següent a la seva entrada en vigor, romanent en vigor fins que s’acordi la seva modificació o la seva derogació expressa.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SEGON.- Donar a l’expedient la tramitació i publicitat preceptiva, mitjançant exposició del mateix en el tauler d’anuncis de l’Ajuntament i en el Butlletí Oficial de la Comunitat Autònoma de les Illes Balears per un termini de 30 dies, dins dels quals els interessats podran examinar-lo i plantejar les reclamacions que estimin oportunes. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;TERCER.- Considerar definitivament adoptat l’Acord, en el supòsit de que no es presentin reclamacions a l’expedient en el termini anteriorment indicat. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;QUART.- Facultar al Sr. Batle-President per subscriure els documents relacionats amb aquest assumpte.”&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra el present acord, en aplicació de l’article 107.3 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i donat que aprova una disposició de caràcter general, es pot interposar recurs contenciós administratiu, davant la Sala contenciosa administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos, a comptar des del dia següent al de la recepció de la present notificació, de conformitat amb l’article 46 de la Llei 29/1998, de 13 de juliol, de la jurisdicció contenciosa administrativa. Tot això sense perjudici de que pugui interposar qualsevol altre recurs que pogués estimar més convenient al seu dret.&lt;/span&gt;&lt;/p&gt;
